New Overtime Regulations

The United States Department of Labor (“DOL”) published a final rule (the “Final Rule”) updating the regulations implementing the Fair Labor Standards Act (“FLSA”), which will automatically extend overtime pay eligibility to over 4 million workers effective December 1, 2016. The FLSA requires that most employees be paid at least the federal minimum wage and overtime pay at time and one-half the regular rate of pay for all hours worked over forty in a workweek. However, the FLSA exempts some employees from these protections, including bona fide executives, administrators and professionals (“White Collar Employees”), including teachers and academic administrators. The Final Rule primarily affects White Collar Employees and, according to the DOL, does not affect hourly employees and teachers. We do not anticipate that the Final Rule will impact school district academic administrators.
